How to request changes to your tenancy.

Feature image

From time to time you may need to make changes to your tenancy. This page details the most frequent tenancy changes we undertake. For anything not listed below, please use our general enquiries form.

Amendments to your tenancy (for affordable living customers)

Derwent Living operates a tenancy amendment policy which ensures we make best use of our housing stock and that we support tenants to exercise their legal rights in relation to tenancies.

This policy includes:

  • Succession (upon death of a tenant)
  • Succession by way of Assignment, where a joint tenant requests to have their name removed from a tenancy (joint to sole)
  • Sole to Joint tenancies
  • Name changes

If you wish to make a tenancy amendment, please email our duty housing officer at tenancyservicesduty@derwentliving.com

Amendments to your tenancy (for residential lettings customers)

If you wish to make a change to those named on your tenancy agreement you will need to contact your Home Ownership Officer to discuss. The rent account would normally have to be paid up to date and there is a £50 administration fee payable at the start of the process. We will also require signed confirmation from all parties.

Sole tenancy change to joint tenancy

You may wish to add a partner or friend to the tenancy agreement. In this instance we will need to check the person wishing to be added to the tenancy is eligible. They would then need to complete an application form and references will be taken. We will also need to see ID and any other documentation required to show they have the ‘right to rent in the UK’

Once the application is approved we will arrange for a Deed of Assignment to be signed by both parties. The original deposit paid will be re-registered in joint names.

Joint tenancy change to sole tenancy

One party to the tenancy may wish to leave and the remaining person wishes to stay at the property and take over the tenancy in their name.

In this instance we will check that the remaining person is financially able to take on the payment of the full rent. Assuming this is the case we will arrange for a Deed of Assignment to be signed by both parties. This will then legally end the person wishing to leave from all future responsibilities associated with the tenancy. The original deposit will be re-registered in the sole name of the remaining tenant.

Joint tenancy change of tenants

One party to a joint tenancy may wish to leave and another person wishes to be added to the joint tenancy. We will need to check that the person wishing to join the tenancy is eligible and then they will need to complete an application form  and references will be taken. We will also need to see ID and any other documentation required to show they have the ‘right to rent in the UK’

Once this application is approved we will arrange for all three parties to sign a Deed of Assignment which will legally end the responsibilities of the person leaving the tenancy and pass these to the person joining the tenancy. The original deposit will be re-registered in the joint names of the remaining and new joint tenant.

Please note that any changes to the tenancy will not be complete until a Deed of Assignment is signed and witnessed by all parties including Derwent Living.
